DMV, DOT, FMCSA Waiver in Response to the COVID-19 National Emergency – For States, CDL Holders, CLP Holders, and Interstate Drivers Operating Commercial Motor Vehicles FMCSA permits, but does not require, States to extend the validity of commercial driver’s licenses (CDLs) and commercial learner’s permits (CLPs) and to waive the 14-day waiting period and grants other waivers from certain regulations applicable to interstate and intrastate CDL and CLP holders and to other interstate drivers operating commercial motor vehicles (CMVs). FMCSA has initiated this action in response to the March 13, 2020 declaration of a national emergency under 42 U.S.C. § 5191(b) related to the coronavirus disease 2019 (COVID-19). The Agency issued waivers on March 28, 2020, June 17, 2020, September 18, 2020, December 15, 2020, February 16, 2021, and May 26, 2021, and August 31, 2021 providing similar relief. DATES: This waiver is effective December 1, 2021and expires on February 28, 2022, upon the revocation of the Declaration of National Emergency under 42 U.S.C. § 5191(b) concerning the COVID-19 public health emergency, or upon early termination by FMCSA, whichever is soonest. FMCSA Extension of the Modified Emergency Declaration 2020-002 Under 49 CFR § 390.25 (November 29, 2021) This notice continues the relief granted in Emergency Declaration 2020-002, as modified on June 15, 2020, August 15, 2020, December 1, 2020, and August 2021, through February 28, 2022 subject to the restrictions and conditions set forth herein unless modified or terminated sooner. This extension of the modified Emergency Declaration addresses national emergency conditions that create a need for immediate transportation of essential supplies and provides necessary relief from the FMCSRs for motor carriers and drivers. DMV, DOT, FMCSA Waiver for States Concerning Third Party CDL Skills Test Examiners In Response to the COVID-19 Emergency (Nov 29, 2021) FMCSA waives the commercial driver’s license (CDL) knowledge test examiner training requirements in 49 CFR 384.228(b)-(c) for certain third-party CDL skills test examiners. This waiver allows State authorized third party-skills test examiners who have maintained a valid CDL test examiner certification and have previously completed a CDL skills test examiner training course that satisfies the requirements of 49 CFR 384.228(d) to administer the CDL knowledge test without completing a CDL knowledge test training course. FMCSA has initiated this action in response to the March 13, 2020 declaration of a national emergency under 42 U.S.C. § 5191(b) (Declaration of National Emergency) concerning the coronavirus disease 2019 (COVID-19). As explained in greater detail below, the Agency issued waivers on April 9, 2020, June 22, 2020, September 18, 2020, December 15, 2020, February 16, 2021, May 26, 2021, and August 31, 2021, providing the same relief. FMCSA Notice of Enforcement Policy Regarding Expiring Driver’s Licenses and Medical Examiner’s Certificates During Covid-19 National Emergency (November 29, 2021) This Notice of Enforcement Policy, effective until February 28, 2022, extends a previous notice that was effective from September 1, 2021 through November 30, 2021. It provides needed relief from specified FMCSRs for CLP holders, CDL holders, and non-CDL drivers and motor carriers using those drivers. This Notice of Enforcement Policy applies to all CLP holders, CDL holders, and non-CDL drivers whose licenses were issued for less than the maximum period established by 49 CFR 383.25 and 383.73 and was valid on February 29, 2020 and expired on or after March 1, 2020.
